1. Acceptance of Terms

By accessing or using Sublark ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Sublark is operated by Sublark ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

Sublark provides a platform that allows YouTube content creators ("Creators") to:

• Connect their YouTube channel via Google OAuth
• Create a public page where viewers can subscribe to email updates
• Collect and manage email subscriber lists
• Send automated email notifications when new videos are uploaded
• Export their subscriber data at any time

3. YouTube API Services

Our Service uses the YouTube API Services. By using Sublark, you also agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms).

We access the following data from your YouTube account:

• Your channel name and profile picture
• Your channel ID
• Basic channel statistics (subscriber count, video count)
• Information about your uploaded videos (for notification purposes)

You can revoke Sublark's access to your YouTube data at any time via your Google Account permissions at https://security.google.com/settings/security/permissions.

4. Google OAuth

We use Google OAuth to authenticate users and access YouTube data. By signing in with Google, you authorize us to access the permissions described during the OAuth consent process. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

5. User Responsibilities

As a Creator using Sublark, you agree to:

• Only collect email addresses from individuals who have voluntarily subscribed
• Comply with all applicable email marketing laws, including CAN-SPAM, GDPR, and CASL
• Include accurate sender information in all emails
• Honor unsubscribe requests promptly
• Not use the Service to send spam, phishing, or malicious content
• Not violate YouTube's Terms of Service or Community Guidelines
• Not impersonate other creators or misrepresent your identity

6. Email Marketing Compliance

Sublark is designed to help you send legitimate email notifications to subscribers who have opted in. You are responsible for ensuring your use of the Service complies with:

• CAN-SPAM Act (US): Include valid physical address, clear unsubscribe mechanism, and accurate header information
• GDPR (EU): Obtain proper consent, honor data subject rights, and maintain records of consent
• CASL (Canada): Obtain express or implied consent before sending commercial emails
• Other applicable laws: Comply with email marketing regulations in your jurisdiction

7. Subscriber Data Ownership

You retain ownership of your subscriber list. You may export your complete subscriber list at any time in CSV format. We do not sell, rent, or share your subscriber data with third parties for their marketing purposes.

8. Prohibited Uses

You may not use Sublark to:

• Send unsolicited bulk email (spam)
• Harvest email addresses without consent
• Distribute malware, viruses, or harmful code
• Engage in phishing or fraudulent activities
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm others
• Attempt to gain unauthorized access to our systems

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

10. Intellectual Property

The Sublark name, logo, and all related trademarks are our property. You may not use our branding without prior written permission. All content you create and upload remains your property.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUBLARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Sublark and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may export your subscriber data before termination.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
